DEWAN NEGARA: Need for law to protect individual privacy

THERE is a need for specific laws to protect the privacy of individuals, said Home Minister Datuk Seri Syed Hamid Albar.

He said the move was necessary to curb the increasing number of cases involving the invasion of an individual's privacy.

Without referring to any case in particular, and in replying to a question from Senator Datuk Roslan Awang Chik, he said currently issues involving invasion of privacy is governed by Sections 292 and 509 of the Penal Code.

Section 292 among others deals with the sale, hiring, distribution, public exhibition and circulation of obscene books, pamphlets, papers, drawings, etc.

Section 509 deals with word or gesture intended to insult the modesty of a person.
To a supplementary question by Roslan, Syed Hamid added that the need for new specific law on invasion of privacy had in fact been discussed at the cabinet level.

"The new cabinet is expected to study the matter in a detailed manner," he said.

To a supplementary question by Senator Mumtaz Md Nawi, he said there is a need for enforcement authorities to be equipped with the necessary hardware to enable them to carry out their investigations.

In addition, the personnel involved in the investigation must also posses the necessary skills in line with the technological development.
